About Our Privacy Policy
VivAir cares deeply about your privacy. Therefore, we only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.
This privacy policy applies to the use of the website and the services provided by VivAir through it. The effective date of these terms is 30/06/2023. By publishing a new version, the validity of all previous versions expires. This privacy policy describes what data we collect about you, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain to you how we store your data, how we protect your data against misuse, and what rights you have concerning the personal data you have provided to us.

Below you can read how we process your data, where we store it (or have it stored), what security techniques we use, and who has access to the data.
E-commerce Software
Shopify
Our online store is developed with software from Shopify. Personal data that you provide to us for our services is shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Based on the agreement we have with them, Shopify is required to take appropriate security measures. These security measures include the application of SSL encryption and a strong password policy. Shopify uses cookies to collect technical information regarding your use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve its services.
Web Hosting
GOOGLE
We use web hosting and email services from GOOGLE. GOOGLE processes personal data on our behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. These are not personal data. GOOGLE has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. GOOGLE is obligated to confidentiality under the agreement.
For our regular business email traffic, we use the services of GOOGLE. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. GOOGLE does not have access to our mailbox, and we treat all our email traffic confidentially.
Payment Processors

For handling (part of) the payments in our online store, we use the Shopify platform. Shopify processes your name, address, and residence information and your payment details such as your bank account or credit card number. Shopify has taken appropriate technical and organizational measures to protect your personal data. Shopify reserves the right to use your data to further improve its services and, in this context, share (anonymized) data with third parties. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Shopify’s services for which they engage third parties. Shopify does not retain your data longer than permitted by legal time frames.
Klarna
For handling (part of) the payments in our online store, we use the Klarna platform. Klarna processes your name, address, and residence information and your payment details such as your bank account or credit card number. Klarna has taken appropriate technical and organizational measures to protect your personal data. Klarna reserves the right to use your data to further improve its services and, in this context, share (anonymized) data with third parties. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Klarna’s services for which they engage third parties. Reviews
WebwinkelKeur
We collect reviews via the WebwinkelKeur platform. When you leave a review through WebwinkelKeur, you are required to provide your name, place of residence, and email address. WebwinkelKeur shares this information with us so that we can link the review to your order. WebwinkelKeur also publishes your name and place of residence on its own website. In some cases, WebwinkelKeur may contact you to provide clarification on your review. If we invite you to leave a review, we share your name and email address with WebwinkelKeur. Shipping and Logistics
PostNL & DPD Netherlands
When you place an order with us, it is our responsibility to deliver your package to you. We use the services of PostNL and DPD Netherlands for carrying out deliveries. For this purpose, it is necessary that we share your name, address, and place of residence with PostNL or DPD Netherlands. PostNL/DPD Netherlands uses this information solely for the purpose of fulfilling the agreement. In the event that PostNL/DPD Netherlands engages subcontractors, PostNL/DPD Netherlands also makes your data available to these parties.
Billing and Accounting
e-boekhouden.nl
For keeping our records and bookkeeping, we use the services of e-boekhouden.nl. We share your name, address, and place of residence and details related to your order. This information is used for the administration of sales invoices. Your personal data is transmitted and stored securely. e-boekhouden.nl is obliged to confidentiality and will treat your data confidentially. e-boekhouden.nl does not use your personal data for any purposes other than those described above.
Purpose of Data Processing
General Purpose of Processing
We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the order you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time, other than at your request, we will ask for your explicit consent. Your data is not shared with third parties, other than to meet accounting and other administrative obligations. These third parties are all bound to confidentiality by the agreement between them and us or an oath or legal obligation.
Automatically Collected Data
Data that is automatically collected by our website is processed with the aim of improving our services. This data (such as your IP address, web browser, and operating system) is not personal data.
Cooperation with Fiscal and Criminal Investigations
In certain cases, VivAir may be legally obligated to share your data in connection with fiscal or criminal investigations conducted by the government. In such cases, we are compelled to share your data, but we will oppose it to the extent permitted by law.
Retention Periods
We retain your data as long as you are a client of ours. This means we keep your client profile until you indicate that you no longer wish to use our services. If you notify us of this, we will also consider it a request to forget your data. Due to applicable administrative obligations, we are required to retain invoices containing your (personal) data for the duration of the applicable term. However, employees no longer have access to your client profile and documents created in response to your order.
Your Rights
Under the applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on behalf of us. Below we explain what these rights are and how you can exercise them.
In principle, to prevent misuse, we send copies and transcripts of your data only to your already known email address. If you wish to receive the data at another email address or, for example, by mail, we will ask you to identify yourself. We keep a record of completed requests; in the case of a request to forget data, we keep anonymous data. All copies and transcripts of data are provided in a machine-readable format used in our systems.
You always have the right to file a complaint with the Dutch Data Protection Authority if you suspect that we are misusing your personal data.
Right of Access
You always have the right to access the data we process or have processed that relates to you or can be traced back to you. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data to the email address we have on record, along with a list of the processors holding this data, including the category under which we have stored this data.
Right to Rectification
You always have the right to have the data we process or have processed that relates to you or can be traced back to you adjusted. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address we have on record that the data has been adjusted.
Right to Restriction of Processing
You always have the right to restrict the data we process or have processed that relates to you or can be traced back to you. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address we have on record that the data will no longer be processed until you lift the restriction.
Right to Data Portability
You always have the right to have the data we process or have processed that relates to you or can be traced back to you transferred to another party. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or transcripts of all data about you that we have processed or have been processed on our behalf by other processors or third parties to the email address we have on record. In such a case, we will most likely no longer be able to continue the service, as the secure linkage of data files can no longer be guaranteed.
Right to Object and Other Rights
In certain cases, you have the right to object to the processing of your personal data by or on behalf of VivAir. If you object, we will immediately cease data processing pending the resolution of your objection. If your objection is well-founded, we will provide you with copies or transcripts of the data we process or have processed and then permanently cease processing.
Additionally, you have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe that this is the case, please contact our privacy contact person.
Cookies
Google Analytics
Our website places cookies from the American company Google as part of the "Analytics" service. We use this service to track and receive reports on how visitors use the website. This processor may be required to provide access to this data under applicable laws and regulations. We collect information about your browsing behavior and share this data with Google. Google can interpret this information in conjunction with other datasets and thus track your movements on the internet. Google uses this information to offer targeted advertisements (AdWords) and other Google services and products.

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects the way we process data already collected about you, we will notify you of this by email.
